Terms & Conditions
Last updated: October 12, 2026
These Terms & Conditions (the "Terms") are an agreement between you and The Marketing Outlet ("The Marketing Outlet," "TMO," "we," "us" or "our"). They apply to our website at themarketingoutlet.com, our ordering and account platform at app.themarketingoutlet.com (together, the "Site"), and everything we sell or provide through them, including printed products and digital products (together, the "Services"). Please read them carefully. Our Privacy Policy explains how we handle personal information and is part of these Terms.
1. Agreement to these Terms
By visiting the Site, creating an account, placing an order, starting a chat, texting us, or otherwise using the Services, you agree to these Terms. If you are using the Services for a business, you confirm that you have authority to bind that business, and "you" includes the business. If you do not agree, do not use the Services. You must be at least 18 years old to create an account or place an order.
2. What we offer
The Marketing Outlet provides print marketing products such as business cards, flyers, postcards and yard signs, along with design tools, marketing tools and digital products such as digital business cards, QR code destinations, interactive marketing games and related services. Product names, sizes, options, prices and availability are shown on the Site and may change at any time. We may add, change or discontinue any product or feature without notice.
3. Accounts
You can create an account with an email address or by signing in with Google. You are responsible for the accuracy of your account information, for keeping your sign-in credentials secure, and for all activity under your account. Tell us right away if you believe your account has been used without your permission. We may suspend or close accounts that violate these Terms or that we reasonably believe are being used fraudulently or unlawfully.
4. Orders, pricing and payment
- Order acceptance. An order is an offer to buy. We may accept, limit or decline any order, and an order is not final until we begin production or confirm it in writing.
- Prices. Prices are in U.S. dollars. Member pricing and promotions may require an account, have conditions or end without notice. If we discover a pricing or description error, we may correct it and give you the chance to confirm or cancel the affected order.
- Taxes and shipping. Sales tax, shipping and handling are added where they apply and are shown before you pay.
- Payment. You authorize us and our payment processor to charge your selected payment method for the total of your order. Card payments are handled by a third-party payment processor. We do not store full card numbers on our servers. You represent that you are authorized to use the payment method.
- Changes and cancellations. Because products are custom made, changes or cancellations are possible only before production begins. Contact us promptly. Once production has started we cannot cancel or change the order.
5. Artwork, content and approvals
You may upload or create artwork, logos, text, images, offers and other content ("Your Content") to be printed or published through the Services. You represent and warrant that you own Your Content or have all rights and permissions needed to use it, that it does not infringe or violate anyone's rights or any law, and that any offers or claims in it are truthful and lawful. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt and display Your Content as needed to produce, deliver, host and support your order and the Services. We may also show finished work in our portfolio or marketing unless you ask us in writing not to.
- Review before approval. You are responsible for reviewing every proof, preview and order summary for spelling, phone numbers, addresses, URLs, QR codes, dates, offers, images and layout. Once you approve or submit an order, we print what you approved.
- Color and finish variance. Colors on screens differ from printed colors. Reasonable variation in color, trim, alignment and stock between print runs is normal and is not a defect.
- Right to refuse. We may decline or remove content that we believe is unlawful, infringing, deceptive, offensive or unsuitable for production.
- Legal compliance. You are solely responsible for the legal compliance of your marketing, including required disclosures, licensing, advertising, privacy, anti-spam and consumer protection laws.
6. Production, vendors and fulfillment
Sourcing from multiple vendors. We may produce, finish, pack and ship your order ourselves or through one or more third-party printers, manufacturers, suppliers, fulfillment partners and carriers ("Vendors"). We choose Vendors at our discretion, may change them at any time, and are not required to tell you which Vendor produced or shipped a particular order or where it was produced.
Orders, or parts of an order, may be produced and shipped from different locations or by different Vendors, and products in a single order may arrive separately. We remain responsible to you for your order as described in these Terms. Vendors are independent businesses, and nothing in these Terms creates a partnership, agency or employment relationship between us and any Vendor. You agree that our Vendors may receive the information needed to produce and deliver your order, including your artwork and shipping details. You do not have any contractual rights against our Vendors under these Terms, and our Vendors are not responsible to you directly except as the law requires. Vendor-specific specifications, templates and minimums may apply to the product you select.
7. Shipping and delivery
Production and delivery times shown on the Site are estimates, not guarantees. They begin after your order and artwork are approved and payment is received, and they can be affected by weather, carrier delays, supply shortages, holidays, proof revisions and other events outside our control. Please provide an accurate and complete delivery address; we are not responsible for orders delayed, lost or misdelivered because of an incorrect address you provided. Risk of loss passes to you when the carrier takes possession of the order. If a shipment appears lost or damaged in transit, contact us promptly so we can help you file a claim with the carrier.
8. Quality issues, reprints and refunds
Because your products are custom made, we do not accept returns or give refunds for change of mind or for errors in artwork you approved. If your order arrives defective, damaged or materially different from what you approved, contact us within 7 days of delivery with your order number and clear photos. After we review the issue, we will, at our choice, reprint the affected items, give a credit or refund the affected portion of the order. Please keep the products until we respond. This section describes your exclusive remedy for quality problems, to the extent the law allows.
9. Digital products and QR codes
Digital products, such as digital business cards, QR code destinations, landing pages and interactive games, are provided as a service, not as software you own. We grant you a limited, non-exclusive, non-transferable, revocable right to use the digital products you purchase for your own business while your account and any applicable plan are in good standing. QR codes and digital destinations printed on your products point to content we host; if a plan ends, is suspended or is canceled, the destination may stop working, and we are not responsible for printed items that continue to point to it. Some digital products are labeled "preview" or "prototype." Those are provided as is, may change or be withdrawn, and should not be relied on for critical business operations. We do not guarantee that any digital product will be uninterrupted or error-free.
If your digital product collects information from your own customers, such as names, phone numbers or email addresses, you are the party responsible for that information. You must have a lawful basis and any required consent to collect it and to contact those people, and you must provide any privacy notice the law requires. We process that information on your behalf as described in our Privacy Policy.
10. Games, promotions and contests
If you use our products to run a game, giveaway, sweepstakes, contest or other promotion, you are solely responsible for its rules, eligibility, odds, prizes, record keeping, taxes, registrations, bonding, and compliance with all laws, including laws on lotteries, sweepstakes, skill contests and advertising in each place where it is offered. Prizes, if any, are provided and honored by you, not by us. Unless we state otherwise in writing, demonstration or preview results in our tools are samples only and do not award any prize. We do not provide legal advice, and you should consult your own attorney about any promotion.
11. Marketing results
Marketing outcomes depend on many factors we do not control. We do not guarantee any particular level of leads, sales, traffic, rankings, response or return on investment. Scores, estimates, previews, mockups and recommendations, including any "visibility score," are informational and are not a promise of results.
12. Text messaging terms
Program: The Marketing Outlet customer messaging. Message frequency varies.Message and data rates may apply. Reply STOP to cancel at any time. ReplyHELP for help. Consent to receive texts is not a condition of any purchase.
What you are agreeing to
If you give us your mobile number and agree to receive texts, for example by entering your number in our website chat, an order or account form, an inquiry, or by texting us first, you agree that The Marketing Outlet may text you at that number. Texts may include replies to your questions, quotes and estimates, order, proof, shipping and account notices, appointment or follow-up messages, and, only if you opted in to them, promotions and offers. Messages may be sent using an automatic telephone dialing system or messaging platform. Providing your number for texting is optional, and you can still shop and use the Site without agreeing to marketing texts.
Opting out and getting help
You can cancel the messaging program at any time by replying STOP to any message. You will get one confirmation text and then no further messages unless you opt in again. For help, replyHELP, call 1-888-718-6584, or emailhello@themarketingoutlet.com. Even after you opt out of promotional texts, we may still contact you about an open order or your account by other means.
Costs, carriers and your information
Message and data rates may apply according to your wireless plan. Carriers are not liable for delayed or undelivered messages. Message frequency varies depending on your requests and activity. Your mobile number and your text messaging consent are handled as described in our Privacy Policy; we do not share mobile information or text opt-in consent with third parties or affiliates for their marketing or promotional purposes.
13. Website chat and third-party services
Our website chat is provided with technology from LeadConnector, LLC. When you use chat, your messages, the contact details you enter and information about your device and visit are processed by LeadConnector on our behalf, and your use of chat is also subject to LeadConnector'sTerms of ServiceandPrivacy Policy. Chat is not for sensitive information such as payment card numbers, government ID numbers or passwords. Please do not enter them.
The Services also use or link to other third-party services, such as Google (for sign-in), payment processors, email and shipping providers. Those services have their own terms and privacy practices, and we are not responsible for them. A link to a third-party site is not an endorsement.
14. Acceptable use
You agree not to, and not to help anyone else to:
- use the Services for anything unlawful, fraudulent, deceptive, harassing, hateful or defamatory, or to send spam or text anyone without the consent the law requires;
- submit content that infringes intellectual property, privacy or publicity rights, or that contains malware, adult content, or illegal goods or services;
- interfere with, probe, scrape, overload or attempt to break the security of the Site or the Services, or access accounts or data that are not yours;
- resell or sublicense the digital products, or misrepresent your identity or your affiliation with us; or
- use the Services in a way that creates legal or reputational risk for us, our Vendors or other customers.
15. Intellectual property
The Site, our templates, tools, designs, software, text, graphics, logos and trademarks, including "The Marketing Outlet," belong to us or our licensors and are protected by law. Except for the limited rights expressly granted here, we grant you no rights in them. As between you and us, you keep ownership of Your Content. Unless we agree otherwise in writing, templates and stock elements we provide may be used only in products you buy from us. If you send us feedback or ideas, you agree we may use them freely without obligation to you.
16. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR VENDORS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT PRINTED OR DIGITAL PRODUCTS WILL ACHIEVE ANY RESULT. Some places do not allow certain disclaimers, so some of these may not apply to you.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MARKETING OUTLET, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, VENDORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, LEADS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PARTICULAR ORDER OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Nothing in these Terms limits liability that cannot be limited by law.
18. Indemnification
You agree to defend, indemnify and hold harmless The Marketing Outlet, its owners, officers, employees, agents and Vendors from any claims, damages, losses, liabilities and expenses, including reasonable attorneys' fees, arising out of or related to Your Content, your marketing, promotions or messaging campaigns, your violation of these Terms or any law, or your violation of any third party's rights.
19. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and give us at least 30 days to try to resolve the dispute informally. Any dispute that is not resolved will be brought only in the state or federal courts located in or serving Cumberland County, Pennsylvania, and you consent to those courts' jurisdiction and venue. To the extent the law allows, claims must be brought individually and not as a plaintiff or class member in any class or representative action.
20. General terms
- Changes. We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use of the Services after a change means you accept it. Orders are governed by the Terms in effect when you placed them.
- Suspension and termination. We may suspend or end your access at any time if we believe you violated these Terms or to protect the Services. Sections that by their nature should survive, including payment, content, disclaimers, liability, indemnity and governing law, survive termination.
- Events beyond our control. We are not liable for failure or delay caused by events beyond our reasonable control, including supplier or carrier failures, outages, natural events, labor disputes or government action.
- Entire agreement; severability; no waiver. These Terms and the Privacy Policy are our entire agreement with you about the Services. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, sale or reorganization.
- Electronic communications. You agree we may give you notices and records electronically, including by email, on the Site and, where you opted in, by text.
